Article 1: Meetings

Section 1

The Annual Meeting of the Association shall be held on the first Saturday of February of each year, unless changed for good cause by unanimous vote of the Board after declaring an emergency to exist and notifying the membership at large.

Section 2

Regular meetings of the Association shall be held on the first Saturdays of May, August, and November, of each year, unless changed by a majority vote of the Board upon at least thirty (30) days notice to the membership at large.

Section 3

Special meetings of the Association for business, educational, or social purposes may be held on the call of the President with due and timely notice of the membership.

"Special Meetings shall also be called by the President upon the filing with the Secretary of a petition for such meeting signed by no less than 24 members in good standing who shall represent no less than 7 differnet private and public entities. Such meeting shall be scheduled no less than 15, no more than 45 calendar days after filing of said petition, and the Secretary shall notify the membership of the date and location of said meeting without unnecessary delay. In the event the President is unable, or otherwise fails to act, the Special Meeting shall be called by the Vice-President; or in the event of his unavailability or other failure to act; by the Board Chairman."

Section 4

Meetings shall be held at such locations as from time to time may be selected by the President, and at such hours as he may direct.

Section 5

A quorum to transact business shall consist of not less than twenty-four (24) members in good standing, and who shall represent not less than seven different public and private entities.


Article 2: Board of Directors

Section 1

The Board of Directors shall meet at least three (3) times in each year, which meetings may be held in conjunction with the Annual and Regular Meetings of the Association. Other meetings of the Board may be held from time to time at the call of the President. All meetings shall be held at such time and place as the President may direct.


Article 3: Miscellaneous

Section 1

The fiscal year of the Association shall begin on the date of the Annual Meeting in each year. Elected officers shall be installed immediately after election and shall hold office until their successors shall be elected and qualified. Appointive officers and officers elected or appointed to fill vacancies shall hold office until the next Annual Meeting.

Section 2

The annual dues for the members in each class of membership shall be fixed by the Board of Directors. Dues shall be payable annually in advance.

Section 3

The Treasurer shall maintain a commercial bank account exclusively for the funds of the Association, and all disbursements shall be by check. The financial books of the Association shall be audited annually by the Board of Directors, and may be audited at such other times as the Board may elect.


Article 4: Amendments

Section 1

These By-Laws may be amended by a vote of two-thirds or more of the eligible votes present and voting at the Annual or any regular meeting of the Association.


Article 5: Standing Committees

Section 1

The Membership and Grievance Committee shall be composed of the Board of Directors who shall consider and act upon all matters relating to membership or grievances in accordance with the Constitution and By-Laws of the Association. The President shall serve as Chairman; the Vice-President as Vice-Chairman; and the Chairman of the Board shall serve as Second Vice-Chairman.

Section 2

The Awards Committee shall consist of three members appointed by the President, who shall designate one appointee as Chairman. The term of membership shall be for one (1) year, or until successors are duly appointed by the President. Members shall be responsible for selecting and recommending to the Board of Directors individuals who deserve special recognition for meritorious services to the profession. Committee recommendations shall require approval by the Board of Directors.


Article 6: Principles of Practice

Section 1

In order to keep abreast of the State of the art and to maintain professional standards in the field, Examiners shall be required to attend polygraph workshops or seminars conducted by institutions or organizations recognized by the institutions or organizations recognized by the Association to conduct such seminars or workshops at least once every two (2) years. Such workshops or seminars shall total at least sixteen (16) hours and the content must relate directly to polygraph procedure. Such hours need not be in a single seminar or workshop but may be accumulative over a period of two (2) years.

Section 2

An Examiner shall not administer detection of deception examination for the purpose of determining truth or deception or issues not reasonably related to the position for which the Subject is applying or in which he is employed or the object of investigation. The Board of Review appointed by the President, upon inquiry, shall determine whether an area of questioning is reasonably related to the purpose of the examination. (No provision of this Section shall be construed as a restriction upon the requirements of a sworn police officer's duty.)

Section 3

Distracting Influences: An Examiner shall conduct examinations in a facility wherein distracting visual and auditory stimuli are adequately minimized or eliminated so that, especially during the testing perids, the Subject does not perceive stimuli that would tend to cause physiological occurrences unrelated to truth and deception. The Examiner shall control the conditions in the examining room to the greatest extent possible so that extremes of temperature, sound and light do not exist.

Section 4

Detention: An Examiner shall conduct examinations in a facility where the Subject may readily leave the facility whenever he so desires unless he is in legal custody.

Section 5

Adequacy: An Examiner shall use an instrument which records permanently and simultaneously the Subject's respiration, blood pressure-pulse, and Galvanic Skin Response (GSR). No Examiner shall conduct an examination on any person unless he uses an instrument which makes a permanent, simultaneous recording on a moving chart of at least three physicological tracings: The pneumograph, the cardiovascular activity, and the GSR. This shall not preclude the recording of additional physiological phenomena. The provisions of this paragraph shall be subject to such modification as may be required to comply with any State or Federal licensing regulation.

Section 6

Number of Tests: An Examiner shall render his professional opinion based on charts alone as to truth or deception on a relevant issue only after the questions relating to that issue have been asked at least once in each of two (2) separate tests.

Section 7

Subject Contact Time: As a standard of professional practice, it is resolved that examinations carried to their normal conclusion should involve the expenditure in Subject contact time of not less than sixty (60) minutes. As a standard of professional practice, any examinations which are conducted in less time than the minimum standard established could represent prima facie evidence of unprofessional practice and conduct by the Examiner and the burden of proof shall be upon the Examiner to show cause why his action did not represent unprofessional conduct.
